This Privacy Policy describes how and when I collect, use, and share information when you purchase an item, contact, or otherwise use my services through my website or its related sites and services. This Privacy Policy does not apply to the practices of third parties that I do not own or control, or any third-party services you access through our website.

Information I collect:

To fulfil your order or answer any queries, you must provide me with certain information, such as your name, email address, postal address, payment information, and the details of the product that you’re ordering. You may also choose to provide me with additional personal information (for a custom order for example), if you contact me directly.

Why I need your information:

I rely on a number of legal bases to collect, use, and share your information, including those needed to provide my services, such as when I use your information to fulfil your order, settle disputes, or to provide customer support.

When you have provided your affirmative consent, which you may revoke at any time, such as by signing up for our mailing list; if necessary to comply with a legal obligation or court order or in connection with a legal claim, such as retaining information about your purchases if required by tax law; and as necessary for the purpose of my legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as 1) providing and improving my services. I use your information to provide the services you requested and in my legitimate interest to improve my services; and 2) Compliance with our terms and conditions and GDPR regulations.

Information about my customers is important to my work. I may need to share your personal information for very limited reasons and circumstances, as follows:

Service providers: I may engage certain trusted third parties to perform functions and provide services, such as any delivery companies. I will share your personal information with these third parties, but only to the extent necessary to perform these services.

Business transfers: If I sell or merge my work, I may disclose your information as part of that transaction, only to the extent permitted by law.

Compliance with laws: I may collect, use, retain, and share your information if I have a good faith that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or Sharing information disclosure:(d) protect the rights, property, and safety of my customers, or others.

I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations, to resolve disputes, and to enforce my agreements. I generally keep your data for the following time period: 4 years.

Your legal rights: If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. I describe these rights below:

Access: You may have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.

Change, restrict, delete: You may also have rights to change, restrict my use of, or delete your personal information.

Absent exceptional circumstances: (like where I am required to store data for legal reasons) I will generally delete your personal information upon request.

Object: You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me after providing your expressed consent to receive them. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.

Complaints: If you reside in the EU and wish to raise a concern about my use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.

Return policy

I cannot accept returns for digital downloads, personalised or custom-made orders unless they are faulty.  For all other orders, Mintilla has a 14 day return policy if you are not completely happy with your purchase. Items must be returned 14 days after receiving your order.

Should you wish to request a return or query any part of your order; please contact us in the first instance. Cost of item(s) will be reimbursed once we have received your return, however we will not reimburse delivery cost. Please note it is the customers responsibility to arrange return postage and costs which I cannot refund. Reimbursement for your item(s) will be made using the same payment method as the original payment. Mintilla reserves the right to deduct monies from reimbursement should the item value be reduced by unnecessary handling by the customer.


TERMS AND CONDITIONS:

Mintilla is a small family friendly run business providing original prints/designs and textile creations. Designs are available to buy via digital download; any physical products can be requested as custom orders. Such products are made using materials from carefully selected suppliers not widely available from high street stores.

The ordering process:

Designs can be purchased via my Etsy store, Ravelry, website or by direct contact (should you request a custom order/help creating) as soon as recent work is uploaded to our platforms. Customer/bespoke designs will require a minimum of at least 2 weeks turnaround which may be lengthened or shortened depending on busier periods. In such circumstances, you will be notified of any such situations. Please note by purchasing any of my designs, placing orders or direct request for custom orders; you are agreeing to the terms and conditions as indicated below.

Payment:

Preferred method of payment is PayPal; however, I also accept most major credit/debit cards on my Etsy store. Once payment is received, you will be able to download any digital files which will be sent directly to the email account you provide when placing your order. Any physical goods/custom made requests will require payment in full prior to any order being fulfilled.

Delivery:

Digital downloads will be sent directly to the email address you provide when placing your order. Any additional or alternative email addresses you would like to receive your design must be specified, and you are accountable to ensure you have provided the correct information to receive your files.

Due to screen resolution on certain devices; please note designs may differ slightly in colour to those advertised in my Etsy store or website.

Orders of physical products will be tracked and delivered using My Hermes and will require a signature upon delivery. This ensures you, as the customer, piece of mind; whilst enabling me to track the status of the order.

Your right to cancel:

Excluding digital files and custom- made orders; under new regulations, customers are notified the right to cancel orders from the date you place your order and up to 14 days of receipt of any goods. If you have any concerns with your order, please get in touch in the first instance as I would be happy to try and resolve any issues.

Returns:

Your legal rights:

When buying from a business you have a number of rights as a consumer by law. This includes the right to claim a refund, repair or replacement under the Sales of Goods Act 1979 where goods are faulty or incorrectly described.

This excludes situations whereby the item has suffered accidental damage, misuse or the effects of reasonable wear and tear. It is the responsibility of Mintilla to ensure I supply you with goods that meet your rights as the consumer. If you have any concerns I have not met your legal rights, please get in touch.
